CONDITIONS OF SALE

These terms and conditions govern the sale contract between the purchaser (hereinafter referred to as “Buyer”) and Milesi Luigi Pasticceria Bigio & C. – Via Papa Giovanni XXIII No. 56 – 24016 San Pellegrino Terme (BG) – P. Iva: IT02845060165 – C.F.: 02845060165 (hereinafter referred to as “Seller”).

1. Contents of terms and conditions of sale

The following general conditions of sale govern all contracts of sale entered into between the Purchaser and the Vendor through the site www.bigio.info . Each contract is subject to the terms and conditions of sale posted on the website at the time when the contract is concluded.

– Any changes proposed by the Purchaser is not likely to change the general conditions of sale, unless expressly accepted in writing by Seller.

– Prices, discounts and specifications of the items may vary without notice. E’ therefore your responsibility to keep up to date on the same by visiting the website. Although we try to maintain the same as current as possible, product availability can not be guaranteed.

– The Seller will check the availability of the required goods and will send written confirmation of the preparation and delivery. In the case where one or more ordered products were not available, the customer will be contacted and notified and can decide whether to buy what is available or to cancel the order. The client will pay only the goods actually delivered by “bigio.info”.

– In case of prepayment of an incomplete order, “bigio.info” will return the difference of the amount paid, but not delivered.

– The goods are ready to ship, is given to the customer for 3 days pending notification dell`avvenuto payment.

2. Transazioni online

The online store www.bigio.info is intended for the exclusive use of consumer, it is therefore reserved for retail sale.

3. Orders

The purchase order has the force of a binding contract. The purchase order is accepted by the Seller with a receipt sent via e-mail, which contains part of the conditions of sale (Product Description, price, how to pay). 4. Prices and shipping costs

The price of the products is that resulting from the price list published on the day the order is issued and before the order.

The prices indicated are for deliveries to addresses within the national territory and therefore include VAT.

Delivery will be made by courier. The shipping and delivery will be calculated at the end of the order and will vary depending on weight of shipment.

In the case where the weight of the shipment exceeds the 30 Kg., Buyer will be contacted directly by the Seller to redefine the cost of shipping.

Delivery will be made within 3/4 working days from the date of purchase, except in the case of payment by bank transfer so it will wait for the notification of payment. These delivery times are not binding; However, the Seller will do everything in its power to respect.

5. Invoices

In cases where it is required to issue an invoice to a private person owning VAT, you will need to indicate whether the tax code, both VAT. Without these you can not issue an invoice and process your order.

The digital invoice will be sent by mail to the address indicated.

6. Payments

PAYPAL®

Payment is by PayPal®, PayPal® directly from the account of the Purchaser or by credit card. BANK TRANSFER

Through your bank, you can make a transfer equal to the total amount of the order (goods + shipping costs) in favor of Luigi Pasticceria Bigio Milesi & C. .

The reason as to indicate the transfer form must state the order number and the name of the person who placed the order on the Internet. Considering that the transmission time of a bank are not immediate, you can anticipate everything by simply sending a fax or email copy of the bank run where they are reported and read all the details and in particular the number of CRO. 7. Warranty

– Legal guarantee of Seller

The Vendor will issue pursuant to and for the purposes of Directive 44/99 / EC of statutory warranty on the product for non-compliance with the quality provided for in the contract of sale, in compliance with applicable laws.

The warranty enables the Purchaser, in case of lack of conformity of the product, to obtain, by contacting the seller directly, within a reasonable time, replacement of the product or the termination of the contract.

It is not in any case covered by warranty the use of the property does not conform to the one established by the Vendor / Manufacturer (operating instructions marked on the product).

Any claim shall mention proof of purchase (tax document issued by the seller / payment).

– Transmission of complaints

The complaint must be filed by the Buyer in a timely manner and no later than 10 gg. the date on which he detected the lack of conformity. During this period, the product can not be used. The claim will be submitted electronically to the Vendor, which shall immediately communicate to the Purchaser the ways in which to return the product.

8. Product liability

Apply the provisions laid down in Directive 85/374 / EEC regarding damage caused by the product.

The Seller, as distributor, is freed from responsibility by indicating the name of the manufacturer.

9. Right of withdrawal

Under the terms and for the purposes of articles. 50 ss. Part D.lgs. 6 September 2005, n. 206 (Consumer Code) in respect of distance contracts, Purchaser will have the right to terminate this contract, without obligation to state the reasons and to pay any penalty, within 10 working days of receipt of the goods covered by the contract itself.

The right of withdrawal is exercised by sending, within the period specified in 10 days from receipt of goods, of a written notice by registered letter with acknowledgment of receipt at:

The Client, if it intends to exercise the right of withdrawal, must provide, at his own expense, return of the asset or assets covered by the contract, within 10 working days from the date of receipt of goods, taking care to deliver it at the venue indicated above. The returned product must be intact and complete with all accessories, original box and papers attached (invoice).

It is understood that the risks of transport for the return of the products will be fully borne by the Buyer.

Do not send the return COD as it would be automatically rejected.

The Seller reserves the right to 30 days in order to carry out checks on the integrity of the product delivered and to be able to make any refund by check and accompanying letter sent directly.

The reimbursement will cover only the value of the article made, with the exception of transport costs.

10. Privacy policy

Pursuant to the Law 31/12/1996 n. 675, The client acknowledges that the “personal details” communicated and / or exchanged, even during the pre-contractual information, will be handled in accordance with, for the effects and with the purposes of Article. 12, paragraph 1, lettera b), c), d) ed f) Law 675/96 and subsequent amendments and additions.

11. General

The conditions contained in this document may be changed without notice and will be valid from the date of publication on the website www.bigio.info

12. Jurisdiction and applicable law

Any dispute relating to the application, execution, and breach of this contract is subject to Italian law. Any dispute between the parties relating to this contract shall be the competent court of BERGAMO.
